La Asamblea Legislativa dio ayer vida a la Ley de Acceso a la Información Pública, tras aceptar parcialmente las observaciones del Ejecutivo. Sin embargo, la normativa deberá de esperar un año, a partir de la entrada en vigor, para atender las peticiones de la población sobre solicitud de información pública.
El parlamento aprobó parcialmente y con el concurso de 80 diputados –la unanimidad presente al momento de la votación– las observaciones hechas por el Ejecutivo a la normativa decretada a principios de diciembre del año pasado.
La ley conserva su entrada en vigor en 30 días, tras su publicación en el diario oficial, pero el ciudadano tendrá que esperar un año para poder hacer la primera solicitud de información pública a las entidades del Estado. Mientras que la publicación de información oficiosa también comenzará a ser efectiva en un año, luego de entrada en vigor la legislación.
ARENA censuró estos plazos. “No estamos de acuerdo”, dijo el legislador arenero Guillermo Ávila Qüehl, cuya bancada pidió un plazo de 180 días, para ambos casos.
El nombramiento de oficiales de información y de los comisionados que integrarán el Instituto de Acceso a la Información Pública se hará en un plazo de 180 días. El presidente de la República será quien emita reglamentos de aplicación de la ley y nombramiento de comisionados, y tendrá 120 días, tras la vigencia.
El subsecretario de Transparencia y Anticorrupción, Marcos Rodríguez, celebró la decisión del congreso, tras seguir de cerca los debates y la votación y resaltó que las observaciones del Ejecutivo no solo contribuyeron a mejorar la ley, sino a tener voto unánime.
Rodríguez, quien dice que la aplicación de la norma costará al Ejecutivo $19.9 millones, no comprende cómo la bancada arenera objetó el plazo de un año pues recordó que ellos promovieron un proyecto de ley con esos plazos.
“El proyecto de ley que introdujo ARENA en 2008 planteaba un año para que la información oficiosa se hiciera pública, un año para las solicitudes de los ciudadanos y tres años para que los sistemas de archivos funcionaran”, hizo ver Rodríguez.
